    Terms in a Collective agreement with a trade union (as in collective bargaining agreement).

    Terms implied by custom and practice – These are specific to an employer or kind of work. They are arrangements that have never been clearly agreed but over time have become part of the contract.

    Not sure I understand what you are after.
    ALL contract terms are binding. Just look at any contract or agreement. Every single term is binding.
